Mediation
Respectful and collaborative
conflict resolution
When engaging in a legal dispute, mediation is a cost-effective and time-saving alternative to litigation. It offers flexible and creative solutions to conflict, whether that’s a complex civil dispute, homeowner association issue, foreclosure, business dispute, or dissolution of marriage. Through mediation, possibilities are explored, understanding is encouraged, and financial and emotional costs are alleviated.
During mediation, a neutral third party (the mediator) helps people and businesses reach a mutually-beneficial agreement (with or without legal counsel present). Mediators cannot order any specific decision, so each party has control over the outcome of their disagreement, resulting in higher rates of compliance and satisfaction.
Arbitration
Fair and balanced decision-making
When a dispute needs to be resolved with a decision made by a third party, arbitration is an effective option.
The arbitration process is similar to a trial. It generally allows for witness testimony (including expert witnesses), discovery exchanges, and motion practice. It can be binding (no appeal) or non-binding (opportunity to appeal).
However, as opposed to a trial, arbitration is far more flexible, allowing for a resolution that is generally cheaper, quicker, and more satisfying for the parties involved.
PARENTING COORDINATION
Guiding families in transition
When parents experience a high-conflict divorce, it can mean that their joint decision-making efforts regarding their children are strained and often unsuccessful. Parenting coordination is a child-focused, and impartial process that helps parents reduce conflict by utilizing the services of a neutral third party. Parenting Coordinators assist parents in developing their communication skills as co-parents and often make decisions for the family in the event that parents cannot agree on a path forward.
Generally speaking, how well kids adjust to a separation depends on the degree of post-divorce conflict between their parents. While Parenting Coordinators are not permitted to make decisions that result in a substantive change to custody or custodial time, they can help parents resolve disputes respectfully, thus alleviating stress on their children.
Parenting coordinators are generally utilized for a term of 18-21 months, though this timeline can be adjusted to meet the unique needs of each family.
